01Problem
At closing the buyer is asked to choose owner’s title insurance, a vesting, and a deed type, then is upsold a “title lock” subscription that mimics insurance. CFPB: the lender’s policy protects the lender; the owner’s policy protects equity and is optional. FBI IC3 2025: 12,368 real-estate-category complaints and $275.1 million in reported losses; BEC $3.05 billion. Adding a parent to a child’s deed can gift a fractional interest, lose a step-up, and is not a Garn-St Germain due-on-sale safe harbor when the transfer is to the parents.
02Intake
- Draft deed / vesting clause (how names will read) and the purchase contract’s title paragraph.
- Title commitment Schedules A and B (exceptions, requirements, survey).
- Owner’s and lender’s title invoices; simultaneous-issue quote from at least one unaffiliated underwriter.
- AfBA/Appendix D if the title company is lender- or builder-affiliated.
- Marital status, state (community-property vs common-law), who will live there, and relationship of anyone being added.
- Existing mortgage note (due-on-sale) if this is a post-closing add-a-person request.
- County recorder fraud-alert (free) vs any paid “title lock” pitch.
- Gift-tax facts: 2026 annual exclusion $19,000 / lifetime $15,000,000 (IRS Rev. Proc. 2025-32 / IR-2025-103).

Split lender’s policy from owner’s policy. CFPB Ask CFPB en-164: lender’s title insurance is usually required by the mortgagee and covers the loan amount; it does not protect the owner’s equity. Owner’s title insurance is optional, must be labeled on the LE/CD as “Title — Owner’s Title Policy (optional)”, and is a one-time premium. CFPB Ask CFPB en-1993: buying owner’s and lender’s together (simultaneous issue) is usually cheaper than two stand-alone policies. EO 14438 (October 22, 2026) expands a refinance title-acceptance pilot — it does not waive owner’s or lender’s title on a purchase.
- 02
Shop title; Section 9 is the hammer. No seller may require, as a condition of sale, that the buyer purchase title insurance from a particular company (12 U.S.C. § 2608) — civil remedy three times the title charges. Lender may still require a lender’s policy from an acceptable insurer. Affiliated title needs Appendix D, no required use, return on ownership only (12 CFR 1024.15). Get one unaffiliated simultaneous-issue quote before accepting the builder’s or lender’s company.
- 03
Match promulgated rates where the state files them. Texas TDI basic owner’s premium effective March 1, 2026 (−6.2%): ((Face-100{,}000)\times 0.00494+780). $400,000 → $2,262; $500,000 → $2,756. Florida r. 69O-186.003: $5.75/thousand to $100k then $5.00/thousand → $400,000 = $2,075. Who pays is custom, not federal law.
- 04
Read Schedule B before arguing about the policy. Exceptions (easements, CC&Rs, unpaid assessments, survey overlaps, prior reservations) are what the policy will not cover unless deleted. A survey or an endorsement (comprehensive, mineral, survey) is often the cheaper fix than a fight over the premium. Unreleased prior mortgages and name-similar judgments are requirements that must be cleared before closing — they are not “title lock” problems.
- 05
Choose vesting on purpose; default forms are not neutral.
- Sole ownership. One name; passes by will or intestacy (probate).
- Tenancy in common. Undivided fractional interests; each owner can deed or will their share. Default in many common-law states if the deed is silent. A parent added this way owns a slice; their creditors can reach it.
- Joint tenancy with right of survivorship (JTWROS). Equal shares; survivor takes outside probate. A joint tenant can usually sever by conveying their share. Language must say survivorship; “joint tenants” alone is not enough in every state.
- Tenancy by the entirety (TBE). Married spouses only, in states that still recognize it (commonly counted around two dozen; confirm the property state). Survivorship plus, in many TBE states, protection from one spouse’s individual creditors. Florida, Pennsylvania, Maryland, Massachusetts, Michigan, North Carolina and others still use TBE — look up this county’s deed form.
- Community property. AZ, CA, ID, LA, NV, NM, TX, WA, WI (opt-in AK, FL, KY, SD, TN). Acquisitions during marriage with community funds are generally 50/50. CA / ID / WA community property with right of survivorship is a statutory overlay. IRC § 1014(b)(6) can give a double step-up on the first death — converting community property into joint tenancy can forfeit that. New Mexico vesting advice is state-specific.
- 06
Adding parents to a child’s deed is a transfer. Effects: (a) a gift of a fractional interest (2026 annual exclusion $19,000 per donee; excess uses the $15 million lifetime exemption and needs Form 709); (b) the new owner’s creditors and later divorce can attach the house; (c) IRC § 121 exclusion ($250,000 / $500,000) can be diluted; (d) the gifted slice generally takes carryover basis; (e) the due-on-sale clause may be callable.
- 07
Garn-St Germain is narrower than family lore. 12 U.S.C. § 1701j-3(d) protects a transfer to a spouse or children of the borrower, a transfer on death to a relative, a transfer into an inter vivos trust where the borrower remains beneficiary, and a junior lien. Adding parents onto a child’s deed is the reverse direction and is not (d)(6). Get the servicer’s written waiver before recording.
- 08
Deed type is the seller’s warranty, not a title policy. General warranty: defects including those before the seller owned. Special / limited warranty: only the seller’s ownership period (builders, banks, REO). Quitclaim: no warranties; usual instrument in gift, divorce cleanup, “add a name,” and deed-theft attempts. Grant deed (Cal. Civ. Code § 1113): implied covenants the grantor has not conveyed the same estate and has not encumbered it. Bargain-and-sale: eastern-state conveyance without the full warranty stack. Recording perfects against later purchasers; it is not fraud insurance.
- 09
Paid “title lock” is a lookalike product. FTC alert, August 26, 2024: “Home title lock insurance? It’s not a lock at all.” Subscriptions monitor recordings; they are not title insurance and do not prevent a forged deed from being recorded. The high-dollar event at purchase is wire diversion (BEC). County property-fraud alert programs do the monitoring job. Owner’s title insurance, if purchased at closing, defends covered defects including certain forgeries back to the policy date, subject to Schedule B.
- 10
If a forged or surprise deed already recorded: get the recorded instrument, compare signatures, file a police report, record an affidavit of fact, notify the owner’s title insurer in writing, and sue to quiet title. Do not pay a cold-call “recovery” firm. Report at ic3.gov.
- 11
Wire protocol + owner’s-title decision. Two named contacts, numbers written down in person. Ignore “updated wiring instructions” emails. Same-day recall + IC3 if funds moved. Buy owner’s (simultaneous-issue) on a purchase unless a cash buyer who will re-sell immediately takes Schedule B risk in writing. Skip paid title-lock. Enroll in the county’s free recording alert the week of closing.
04Checklists

“Is this a general warranty, special warranty, grant, or quitclaim deed?”
- Q07
“Does this county offer a free deed-fraud alert, and will you enroll my parcel at recording?”

06Red flags
“You have to use our title company” from the seller or builder
Owner’s policy not marked (optional), or bundled into a “title package” with no simultaneous-issue math
Adding a parent to “help with the tax freeze” without gift-tax and due-on-sale analysis
Quitclaim from a person who cannot prove they own the interest
Paid title-lock upsell at the closing table (“insurance for your deed”)
Email changing wiring instructions
Deed with the wrong marital status or missing survivorship language
Title commitment with open prior mortgage treated as “standard”

12 U.S.C. § 2608 prohibits requiring, as a condition of sale, that I buy title insurance from a particular company; the remedy is three times the title charges. CFPB Ask CFPB en-164 states that owner’s title insurance is optional and protects my equity; Ask CFPB en-1993 states simultaneous issue is usually cheaper. Please send the Appendix D AfBA disclosure if [company] is an affiliate, quote simultaneous-issue owner’s + lender’s, and match any promulgated rate (Texas TDI March 1, 2026 chart: $2,262 at $400,000 face). I decline [product name] title-lock. The FTC’s August 26, 2024 consumer alert states these products are not a lock and are not title insurance. Please record the deed as instructed and enroll parcel [APN] in this county’s free recording-notification program. I will keep the owner’s title policy jacket with policy number [number].
I will not record a deed adding [names] until I have: (1) a written servicer statement on loan [number] that it will not exercise due-on-sale (12 U.S.C. § 1701j-3 does not list a transfer to parents as protected); (2) a vesting choice (tenancy in common vs JTWROS) in writing; and (3) a gift-tax calculation against the 2026 $19,000 annual exclusion (Rev. Proc. 2025-32) and Form 709 if needed.

09Formulas & rules
- Texas owner’s premium: ((Face-100{,}000)\times 0.00494+780). $400,000 → $2,262. Simultaneous-issue split (TRID comment 37(g)(4)-2): disclose lender’s at full premium; owner’s = (full owner’s + simultaneous lender) − full lender’s.
- Treble damages illustration: $2,262 owner’s + $1,175 lender’s = $3,437 × 3 = $10,311 if § 2608 is proven (use the actual invoices).
- Gift of half a $417,500 house to one parent: $208,750 gift − $19,000 exclusion = $189,750 against the $15,000,000 lifetime exemption; Form 709 due April 15, 2027. The parent now owns half; their creditor can reach it.
- Garn-St Germain (d)(6): transfer to a spouse or children of the borrower — protected. Child → parents: not in that list.
- § 121: $250,000 ($500,000 MFJ) of gain; adding a non-resident parent can shrink the family’s exclusion. Community-property step-up: IRC § 1014(b)(6) — both halves may step to FMV at the first death; converting to JTWROS can forfeit that.
10State variation
- Community property: AZ, CA, ID, LA, NV, NM, TX, WA, WI; opt-in AK, FL, KY, SD, TN. NM vesting advice is state-specific.
- TBE: only where the state still recognizes it. Florida TBE is widely used for homestead spouses. California grant deed (Civ. Code § 1113) plus CPWROS (Civ. Code § 682.1).
- Texas title rates −6.2% March 1, 2026 (TDI Order 2025-9697).
- FTC title-lock alert August 26, 2024, still posted. FBI IC3 2025 (released April 2026): real estate $275.1 million / 12,368 complaints; BEC $3.05 billion.
- EO 14438 (October 22, 2026): refinance title-acceptance expansion — not a purchase owner’s-policy waiver.
- Gift/estate 2026: annual exclusion $19,000; basic exclusion $15,000,000 (Rev. Proc. 2025-32, IR-2025-103, October 9, 2025).
- ALTA 2021 forms effective July 1, 2021; 2006 forms decertified December 31, 2022 but still legally usable.

- Get advice before adding family to the deed (r/Mortgages tax-freeze thread) — Verified as the right instinct. Gift tax, basis, § 121, creditors, and Garn-St Germain are the official reasons. No comment-level tactic is treated as law.
- Paid title-lock as “the way to stop deed theft” — Rejected. FTC August 26, 2024: not a lock and not title insurance. Use county alerts + owner’s policy.
12Fact-check notes
- CFPB Ask 164 / Ask 1993 — works; owner’s optional; simultaneous usually cheaper.
- 12 U.S.C. § 2608 — works; treble damages. 12 U.S.C. § 1701j-3 — works; adding parents is not a protected transfer.
- FTC title-lock — works, August 26, 2024; “not a lock / not title insurance.”
- IRS IR-2025-103 / Rev. Proc. 2025-32 — works; $19,000 / $15,000,000 for 2026. Newsroom URL only.
