Situation first-party homeowners (or commercial property) claim already open; deciding whether to hire a public adjuster

01Problem

A public adjuster (PA) is a state-licensed representative who works for the insured on a first-party property claim. Staff and independent adjusters work for the insurer. In Texas the PA’s percentage can be charged on the entire settlement, not the increase. TDI consumer tip (Mar 25, 2025): if the company wants to pay $100,000 and you are disputing $20,000, a PA at the 10% cap could charge $10,000 — even if the offer does not move. Florida is the opposite on pre-contract money: 0% of amounts paid or agreed before the PA contract, and the fee cannot be calculated on the deductible.

02Intake

  • Declarations, full policy, DOL, peril, claim number, every estimate and check; current offer (RCV, ACV, holdback, deductible).
  • Competing contractor or engineer estimate; whether coverage is admitted, partially denied, or fully denied.
  • State of the property and of the PA’s license; proposed contract (fee %, base, cancel clause, 18-point/12-point notices).
  • Emergency/disaster flag (Florida 10% vs 20%); whether the insurer already paid or committed to limits (TX 72-hour carve-out; FL 1%/14-day).
  • Mortgagee name; joint-payee checks.

03Playbook

  1. 01

Confirm you actually need a PA. DIY-first: contractor estimate in; engineer if causation is disputed; appraisal if coverage is admitted and the fight is amount (skill 1). Hire a PA when the estimate gap is large relative to the fee cap, the loss is complex (fire, major water, hurricane matching/code), you cannot produce an Xactimate-quality estimate, and coverage is at least partially admitted. A PA cannot turn excluded flood into covered wind. Neither can appraisal.

  2. 02

License lookup before any fee conversation. TDI Help Line 800-252-3439 (license, complaints, discipline). Florida DFS license search; CDI; NY DFS; Georgia OCI. A PA selling the roof, or a contractor advertising that they will “handle the insurance,” is a licensing problem (Tex. Ins. Code § 4102.158: PA may not participate in reconstruction; contractors cannot advertise that they will handle the claim).

  3. 03

Read the cap for this state and this date of loss. Ceilings, not recommended prices. Negotiate the base (new money vs entire settlement). Florida § 626.854(11): 10% in the year after a declared emergency for that emergency; 20% otherwise; 1% if the insurer pays policy limits within 14 days after DOL or 10 days after the PA contract, whichever later; 0% of amounts paid or agreed before the contract; fee may not be based on the deductible. Cancel: 10 days (emergency: longer of 30 after DOL or 10 after execution). Texas § 4102.104: ≤ 10% of the insurance settlement (TDI: can be on the total; you may still owe if the offer does not move); 72-hour limits carve-out; FIN535; 72-hour rescission. NY 11 NYCRR 25.7: 12.5% after retention; 3-business-day cancel. GA § 33-23-43.3: 33.3% ceiling. CA § 15027: no statutory % cap; AB 597 not enacted; 3-business-day cancel. Worked numbers in Formulas.

  4. 04

Run break-even before signing. If fee is on new money, any increase is mostly yours. If fee is on the entire settlement (Texas default unless you negotiate), a PA is a net loss until the offer moves past the break-even in Formulas. Close numbers → DIY.

  5. 05

Negotiate the base, not just the percent. Fee only above the written offer on the contract date (Florida already forces 0% on pre-contract money; NY is after retention; Texas does not force this). Dollar cap. Fee not taken from the first check so you can start repairs. TDI tells Texans they can put the fee in dollars.

  6. 06

Coverage first, then appraisal. ISO / Tex. Ins. Code § 1813.004: appraisal is amount of loss only (u/SAA_28 holds up). A PA who wants to “invoke appraisal tomorrow” on a partial denial is skipping coverage.

  7. 07

The carrier may stop talking to you. 30-day X post (@CoffeeJointTV): Heritage refused to talk after a PA was hired — community-reported, not a statute. Keep your own copies. A Texas PA cannot lawfully stop you from talking to your insurer (TDI).

  8. 08

Cancel in the window if the contract is wrong. FL 10 days (emergency: longer of 30 after DOL or 10 after execution). TX 72 hours. NY/CA 3 business days. Contract method and certified mail.

  9. 09

No Florida AOB. § 627.7152(13): void on policies issued/renewed on/after Jan 1, 2023. A PA contract is not an AOB and must not be rewritten as one.

  10. 10

DIY still does the PA’s work: line-item estimate, matching/code/O&P, claim-file demand, prompt-pay clocks, refuse full-and-final (skill 1). Advantage is software and time, not a secret statute.

  11. 11

Fire a PA in writing if the relationship is bad; notify the carrier the PA is no longer authorized; demand the file back. Florida 0% still protects pre-contract payments; earned fee on post-contract new money may be owed.

  12. 12

Do not stack percentage fees. Appraisal = amount, each side pays its appraiser. PA = percentage of the claim. Lawyer = coverage/bad faith (FL 624.155 CRN; TX 541/542; CA 790.03) or a third-party limits file (skill 17). 10% PA + 33% lawyer on the same dollars consumes the recovery.

04Checklists

Public adjuster vs. DIY claim decision helper

  • Coverage admitted vs denied vs mixed — PA only if there is a price fight worth the fee
  • Contractor estimate (and engineer if causation is the issue) already submitted
  • PA license verified on the state DOI site; discipline checked
  • Statutory cap identified (FL 10/20/1/0; TX 10% of entire settlement; NY 12.5% after retention; GA 33.3%; CA no % cap)
  • Break-even computed; fee-on-total vs fee-on-delta compared
  • Contract is the state-prescribed form (TX FIN535; NY/CA approved forms)
  • Cancel window calendared (FL 10 days / emergency 30-or-10; TX 72 hours; NY/CA 3 business days)
  • Pre-contract payments listed; Florida 0% confirmed in the contract
  • No AOB on a post-Jan 1, 2023 Florida policy; PA is not the contractor
  • Authorization names the PA and still lets you receive copies
  • Appraisal reserved until coverage is admitted
  • Mortgagee informed that a PA is on the file

05Questions to ask

  1. Q01

“What is your individual and firm license number? Pull it up on [TDI / Florida DFS / CDI / DFS NY] while we are on the phone.”

  2. Q02

“What percentage, on what base — entire settlement, or only amounts above the written offer dated [date]? Put the fee in dollars on $X and on $Y.”

  3. Q03

“Does this DOL fall in Florida’s 10% emergency-year cap or the 20% ordinary cap? Show me the declaration.”

  4. Q04

“The carrier already paid $[amount] on [date]. Confirm your fee on that money is $0 (Florida 626.854) / you will contract a retention (NY / negotiated TX).”

  5. Q05

“If the carrier does not increase its offer, what do I owe you? (Texas: you may still owe.)”

  6. Q06

“Will you invoke appraisal before coverage is admitted? Appraisal cannot decide coverage.”

  7. Q07

“Are you affiliated with any contractor who will bid this job? (Texas 4102.158.)”

  8. Q08

“What is the exact cancel deadline, and the address for cancel?”

  9. Q09

“Will you copy me on every carrier communication within 24 hours?”

06Red flags

  • Door-knock after a hurricane; unlicensed “we’ll handle insurance”

  • Fee on the deductible (illegal in Florida) or fee on pre-contract payments in Florida

  • Texas contract that hides that 10% applies to the entire settlement

  • Percentage plus “administrative” add-ons that together exceed the cap

  • PA who is also the roofer

  • Pressure to sign before you have run the break-even

  • “Appraisal tomorrow” on a coverage denial

  • Contract that purports to stop you from talking to your insurer

  • Florida AOB mixed into the PA contract on a post-2023 policy

  • California pitch that “the law caps us at 10%” (there is no such cap)

License and fee-base email before signing

Before I sign, send: (1) individual and firm license numbers; (2) a redline of the [TDI FIN535 / Florida / NY / CDI] required contract; (3) the fee in dollars on the current written offer of $[current] and on a hypothetical $[current + gap]. Confirm the statutory cap ([Fla. Stat. § 626.854(11) 10%/20%/1%/0% / Tex. Ins. Code § 4102.104 10% of the settlement / 11 NYCRR 25.7 12.5% after retention / Cal. Ins. Code § 15027 no % cap]) and that your fee on amounts paid or agreed before the contract date is $0. I will verify the license on the department site.

Florida cancel during the window

I cancel the public-adjuster contract dated [date] for claim [number] at [address]. This notice is within [10 days of execution / the longer of 30 days after DOL or 10 days after execution for this emergency claim] under Fla. Stat. § 626.854. Do not assert a fee. Confirm in writing that you have notified the insurer you are no longer authorized.

Texas fee-on-total pushback

TDI states a PA can charge up to 10% of the total the company will pay, and uses this example: offer $100,000, dispute $20,000, fee could be $10,000. I will not sign on those terms. Propose [X]% only of amounts above the written offer of $[current] dated [date], dollar cap $[cap], on TDI form FIN535, with the 72-hour cancel restated in this email.

09Formulas & rules

  • Florida emergency-year, new money only. Fee ≤ 0.10 × post-contract payments. Worked: pre-contract $20,000; later $50,000 more. Ceiling = $5,000. Fee on the $20,000 = $0. Insured keeps $65,000 of $70,000 (fee is not charged on the deductible). Ordinary year: 0.20 × $50,000 = $10,000. Fast-limits 1%: $400,000 tendered within 14 days of DOL → ceiling $4,000.
  • Texas 10% of entire settlement (TDI’s example). Offer $100,000; dispute $20,000. If settlement stays $100,000, fee = $10,000, net $90,000 — worse than DIY. If it moves to $120,000, fee = $12,000, net $108,000 (+$8,000 vs DIY). Break-even: 0.9S = 100,000 → S = $111,111. Negotiated new-money 10% on the same $20,000 increase: fee $2,000, net $118,000.
  • New York 12.5% after retention. Retention $100,000; settlement $130,000; fee ≤ 0.125 × $30,000 = $3,750. Georgia 33.3% on a $30,000 increase = $9,990 ceiling — negotiate far below or DIY.
  • Cancel clocks. FL ordinary: signed Oct 30, 2026 → cancel by Nov 9. FL emergency, DOL Oct 20, contract Oct 30: longer of Nov 19 or Nov 9 = Nov 19. TX: signed 2:00 p.m. Oct 30 → cancel by 2:00 p.m. Nov 2.

10State variation

  • Florida ch. 2026-174 amended § 626.854; the 10%/20%/1%/0% structure and 10-day / emergency 30-or-10 cancel remain the operative consumer rules in the 2026 statutes. AOB still void on policies issued/renewed on/after Jan 1, 2023.
  • Texas ch. 1813 appraisal is now mandatory on residential property policies issued/renewed on or after Jan 1, 2026 — a DIY alternative to a PA on amount disputes. 28 TAC §§ 5.9800–5.9806 still proposed as of Oct 30, 2026.
  • California AB 597 (PA percentage cap) not enacted. § 15027 still has no percentage cap. SB 495 100-day emergency proof-of-loss floor (Jan 1, 2026) is a DIY clock, not a PA rule.
  • New York 11 NYCRR 25.7 12.5% after retention unchanged in this pass.
  • Neutral outcome studies that a PA “always” increases settlements by a published percentage were not found in official DOI or legislative-analyst primary sources in this pass. Do not quote vendor ROI figures.

11Community tactics

  • PA at 5% moved a flood estimate “$22k” to “closer to $50K” (r/StPetersburgFL) — Unverified as a general outcome. Anecdote; NFIP caps ($250k/$100k) also limit extra value.
  • Florida 10% first year after a declared emergency, 20% after — Verified against Fla. Stat. § 626.854(11). Commenter was a PA firm; the statute is the source.
  • Settle coverage before appraisal — Verified. ISO / Tex. Ins. Code § 1813.004: amount of loss only.
  • Contractor, then engineer, before a PA — Partly. Right order for many files; a complex fire/hurricane matching claim can justify a PA earlier.
  • Carrier refused to talk after a PA was hired (@CoffeeJointTV) — Partly / community-reported. Not a legal bar; TDI says a Texas PA cannot keep you from talking to your insurer.
  • Dropped: c2cadjuster $124,573.82 → $236,750.40 (vendor). Dropped: OPPAGA “747%” (not confirmed against OPPAGA primary).
