01Problem
NFDA’s 2023 General Price List Study (press Dec. 8, 2023; still the last complete public national median series as of Oct. 30, 2026) put a funeral with viewing and burial at $8,300, $9,995 with a vault, and viewing-plus-cremation at $6,280 — all excluding cemetery plot, opening/closing, and marker. Adding cemetery charges commonly produces an all-in burial outlay in a $12,000–$18,000 range (composite estimate, not an NFDA median). CANA’s 2025 U.S. cremation rate is 62.8%; NFDA projects 64.3% for 2026 (press channel Oct. 28, 2026). Families buy on a 24–72 hour clock from the home that already has the body. Direct cremation, immediate burial, body donation, and green burial are the four low-cost paths; the FTC Funeral Rule (16 CFR Part 453, still the 1994 text) is the federal shopping tool.
02Intake
- Who has legal authority to control disposition under the death-state next-of-kin statute.
- Where the body is now (hospital morgue, medical examiner, nursing home, residence) and any hold or autopsy.
- Ranked goal: direct cremation, immediate burial, body donation, green/natural burial.
- Veteran / spouse-of-veteran status; DD214; national-cemetery interest.
- Faith requirements (timing, tahara, no cremation).
- Three or more funeral homes; phone-quote notes; GPL photos or PDFs.
- Donation programs already of interest (university anatomy vs. for-profit research) and any pre-registration.
- Cemetery deed, if any (plot, vault/liner rule, opening/closing).
- Pre-need contract: trust vs. insurance, account number, guaranteed vs. nonguaranteed, irrevocable or not.
- Medicaid/SSI status; how many certified death-certificate copies are needed.
03Playbook
- 01
Slow first-call. ProPublica’s Sept. 9, 2022 Q&A with Joshua Slocum (then Funeral Consumers Alliance): if the death is in a hospital, ask the morgue to hold the body a couple of days while you call homes. That is hospital policy, not a federal right. Do not authorize removal until you have at least three phone prices for the same scenario.
- 02
Call at least three providers (Slocum said five within 20–30 miles) before an in-person arrangement. 16 CFR § 453.2(b)(1): they must give telephone callers accurate information from the price lists. FTC: callers need not give a name first. FTC’s 2023 phone sweep (278 homes; staff report Nov. 20, 2024): 7.6% gave no prices in business hours (press 7%), 26.3% none after hours; at least 33% quoted packages without itemized prices; 39 warning letters (Jan. 25, 2024). After-hours silence is not automatically a Rule violation. A home that refuses business-hours prices is a violator — hang up. Ask the same four lines at each: direct cremation with alternative container; with purchaser-provided container; immediate burial; basic-services fee.
- 03
Put four paths on one sheet using GPL numbers, not “our complete package.” Direct cremation (453.1(g)): no formal viewing or body-present ceremony; no casket required; the home or crematory must offer an alternative container (453.4(a); 453.1(a)). Immediate burial: burial without formal viewing; same GPL structure. Body donation then cremation of unused tissue. Green/natural burial: no embalming, biodegradable shroud or casket, no vault — cemetery policy decides whether a liner is waived.
- 04
Direct cremation is not local-only. FCA Ten Tips: if you are not using the home for a viewing or ceremony, you can use a funeral home far from where you live; they arrange cremation and mail or deliver the ashes. Ask whether the quoted price includes the crematory fee, medical-examiner/coroner fee, refrigeration, and mileage. FCAPA’s June 2020 Philadelphia survey found $750–$4,340 “for the same exact thing,” with cash-advance crematory fees of $200–$495 extra unless included. That survey is Philadelphia 2020, not a 2026 national median. Do not use an unverified NFDA “$2,645 direct-cremation median”; it is not in the Dec. 8, 2023 public press PDF.
- 05
Ask for “Direct Cremation, All-Inclusive,” then unpack it. If the GPL line is $1,895 and the crematory is a $350 cash-advance, the real number is $2,245 plus certified copies. Refuse a “cremation casket.”
- 06
Hold a memorial without the body. Direct committal plus a later service at a house of worship, park, or home drops embalming, viewing-room, hearse, and printed-package lines (FCA Ten Tips #5–#6).
- 07
Immediate burial: cheapest GPL casket or alternative container; skip embalming and the chapel. Cemetery plot, opening/closing, and liner are separate bills. Outer burial containers are not required by state law anywhere in the U.S. (FTC; 453.3(c)); many cemeteries require a liner so the grave will not sink. Green grounds often waive it. For an eligible veteran, price a national or state veterans cemetery first (free plot, opening/closing, grave liner, government marker, perpetual care, flag, honors). The family still pays the funeral home.
- 08
Body donation is two industries. University / willed-body programs (Revised Uniform Anatomical Gift Act / state acts): FCA says some schools cover all costs; many require the family only to pay transport; ashes generally return within two years. Acceptance is medical, not guaranteed. For-profit research networks: Science Care (sciencecare.com, live Oct. 2026): if accepted, $0 for transportation, death-certificate filing and permits, cremation, and return of remains. Family pays certified copies. Typical return 3–5 weeks after the physician signs the death certificate (2–4 weeks in Arizona). Returned volume typically ¼ cup to 2 cups (Science Care: donors average six research programs). HIV/AIDS or hepatitis B or C exclude. Contact typically within 5 days of death. Science Care is for-profit, reimbursed by research/education clients; final disposition is cremation only. Re-check the live site for the current state footprint. The Reddit “$250” anecdote is not a national average; a funeral home used as middleman can charge real money.
- 09
Green burial. Green Burial Council certifies hybrid, natural, and conservation cemeteries. Use the live cemetery-provider map; do not quote a national cemetery count (directories conflict: map widget “98 shops” on Oct. 30, 2026 vs. 91 certified vs. ~470 green-practice sites). Ask: no embalming, biodegradable container or shroud, vault waived, marker rules, conservation easement, GBC-certified or self-described. VA green-burial pilot (Nov. 26, 2024; 38 U.S.C. § 2404(i); P.L. 117-355): National Memorial Cemetery of Arizona (Phoenix), Pikes Peak National Cemetery (Colorado Springs), Florida National Cemetery (Bushnell). No chemicals/embalming; biodegradable casket, urn, or shroud; cremated or intact remains. Other open national cemeteries still accept naturally prepared remains in ordinary sections.
- 10
In person, take the GPL to keep at the start of any discussion of prices or goods (453.2(b)(4)). See the Casket Price List and Outer Burial Container Price List before the showroom (453.2(b)(2)–(3)). The only non-declinable funeral-home fee is the basic-services fee plus items actually required by law, explained in writing (453.2(b)(4)(iv); 453.4). NFDA 2023 cremation-table median for that fee: $2,495. Third-party casket or urn: the home cannot refuse it and cannot charge a handling fee (FTC).
- 11
Embalming. No state law requires routine embalming for every death (FTC). 16 CFR 453.5: no fee unless (1) law requires it regardless of funeral choice, (2) prior approval expressly for embalming, or (3) they could not reach family after due diligence and later get approval, having disclosed that a fee is charged only if you select a service that requires embalming. Direct cremation plus a surprise embalming charge is a Rule violation. Refrigeration is the usual alternative. Funeral-home viewing policies are not law.
- 12
Stack benefits. SSA lump-sum death payment $255 (42 U.S.C. § 402(i)), generally to a spouse who lived in the same household, else an eligible child; apply within 2 years (Form SSA-8, edition 12-2024). VA burial allowance (va.gov, last updated Oct. 7, 2026): service-connected death on/after Sept. 11, 2001, up to $2,000; non-service-connected death on/after Oct. 1, 2026, $1,032 burial + $1,032 plot. File VA Form 21P-530EZ; NSC burial-allowance claims generally within 2 years after burial (exceptions: VA care; plot/transport; SC death — no time limit). National-cemetery burial is a separate, usually $0, cemetery benefit.
- 13
Get the Statement of Funeral Goods and Services Selected (453.2(b)(5)): each item and its price, cash-advance items, total cost. If the home keeps a rebate on a cash-advance, the Statement must say so (453.3(f)). Pay only the itemized lawful total. Civil penalty: up to $53,088 per Funeral Rule violation (16 CFR 1.98; 2025 levels frozen for 2026, 91 FR 58446 / OMB M-26-11). Complain at ReportFraud.ftc.gov and the state funeral board.
- 14
Pre-need does not automatically lock today’s price. The Rule applies to pre-need sales of funeral goods and services; 453.8(c) excludes insurance. Guaranteed contracts lock the listed services; nonguaranteed contracts apply the proceeds to whatever the GPL is at death. Irrevocable Medicaid/SSI contracts often send leftovers to the state, not heirs (NY GBL § 453; Fla. Stat. § 497.459(6)).
04Checklists

- Same four GPL lines collected from at least three providers by phone
- Direct-cremation quote unpacked: container, crematory, refrigeration, mileage, certified copies
- Immediate-burial quote plus cemetery plot / open-close / liner priced separately
- Donation program fee sheet read; acceptance is not assumed
- Green-burial cemetery checked on the live GBC map; vault waived in writing
- Printed GPL taken home; CPL/OBCPL seen before the showroom
- Embalming declined or authorized expressly; refrigeration used otherwise
- Third-party urn/casket accepted in writing, $0 handling
- Veteran path: DD214, national-cemetery scheduling, VA 21P-530EZ; SSA-8 $255 within 2 years
- Statement of Goods and Services itemized before any payment
- Pre-need identified as guaranteed vs. nonguaranteed, revocable vs. irrevocable
- FTC / state-board complaint file if phone prices or the GPL were refused
05Questions to ask
- Q01
“Read the GPL prices for direct cremation with your alternative container, direct cremation with a container I provide, immediate burial, the basic-services fee, transfer, refrigeration per day, and the crematory cash-advance.”
- Q02
“Is the crematory fee, medical-examiner fee, refrigeration, and mileage inside that ‘all-inclusive’ number?”
- Q03
“Will you accept an urn I buy elsewhere with no handling fee?”
- Q04
“Do you require embalming for a closed-casket identification with refrigeration? Cite the statute, not house policy.”
- Q05
“May I take the GPL, casket list, and outer-burial-container list with me today?”
- Q06
(Donation) “If accepted, what does the family pay, when are ashes returned, and what volume is returned?”
- Q07
(Green) “Is a vault or liner required here, are you Green Burial Council certified, and what container and marker are allowed?”
- Q08
(Veteran) “Will you transport to [national cemetery] and file VA Form 21P-530EZ, and what funeral-home lines remain after the free plot/open-close/liner/marker?”
06Red flags
“I can’t give prices on the phone; you have to come in”
GPL in a binder they will not let you keep
“State law requires embalming” / “state law requires a vault”
“Cremation casket” required for direct cremation
Handling fee on a Costco/online urn
“All-inclusive” that omits the crematory fee
Donation pitched as guaranteed acceptance, or a funeral home’s $2,000+ “donation coordination” sold as the donation itself
Pre-need sold as “locking today’s price” on a nonguaranteed contract
Irrevocable Medicaid funeral priced far above local direct-cremation GPLs (remainder often goes to the state)

I am comparison-shopping under the FTC Funeral Rule, 16 CFR Part 453. I do not need to give my name. Please give current GPL prices for: basic services of funeral director and staff; transfer of remains; direct cremation including the alternative container; direct cremation if I provide the container; immediate burial; refrigeration per day; and the crematory cash-advance if it is not inside the direct-cremation price. Confirm you will accept an urn I purchase elsewhere with no extra fee.
You have taken good care of us, and we would like to give you this business. We cannot afford $[this home’s direct-cremation / immediate-burial price]. Home B’s GPL for the same itemized service is $[X]. Can you meet that price? If you cannot, we will have [name]’s body transferred.
[Name] died on [date] at [location]. I am the [relationship / authorizing person]. Please screen for acceptance today. If accepted, confirm in writing that the family pays $0 for transport, death-certificate filing, cremation, and return of remains, and that the only cost is certified copies. When will ashes be returned, and what volume? If declined, say so immediately so I can book direct cremation.
You embalmed [name] without prior approval expressly described as embalming. 16 CFR § 453.5 forbids a fee for that unless a listed exception applies. We selected direct cremation / immediate burial. Remove the embalming charge of $[X]. If it remains, I will file with the FTC and the [state] funeral board.

09Formulas & rules
- Funeral Rule civil penalty: up to $53,088 per violation (16 CFR 1.98; frozen at 2025 levels for 2026).
- SSA $255 within 2 years of death (42 U.S.C. § 402(i); Form SSA-8).
- VA NSC (death on/after Oct. 1, 2026): $1,032 + $1,032 plot = $2,064 if eligible and buried outside a national cemetery. SC: $2,000. National cemetery plot/open-close/liner/marker = $0.

Worked save:
- Home A GPL: $1,895 direct cremation including alternative container and crematory; third-party urn $80; two certified copies $40. Total $2,015.
- Home B “cremation package” $4,795 with a $1,295 “required” cremation casket. 453.4(a) bans requiring a casket for direct cremation. Buy Home A. Savings vs. B: $2,780.
- FCAPA Philadelphia 2020 spread on the same service: $750 vs. $4,340 = $3,590. Shop the metro, not the first home that took the body.
- Veteran, NSC death Oct. 15, 2026, private cemetery: VA $2,064 toward funeral + plot. Same veteran at Florida National Cemetery green section: cemetery side $0. Science Care if accepted: funeral-home bill $0 except certified copies; ashes in 3–5 weeks (2–4 in Arizona).
10State variation
- Funeral Rule text is still 59 FR 1611 (Jan. 11, 1994). ANPR Nov. 2, 2022 (87 FR 66096); workshop Sept. 7, 2023; no NPRM and no Part 453 amendment as of Oct. 30, 2026. Online GPL is still not federally mandatory. PRA extension without change: OMB 3084-0025 approved Aug. 25, 2026, expires Aug. 31, 2029. Civil penalty $53,088, frozen for 2026 (91 FR 58446).
- FCA (2024 list): nine states require a funeral director for some paperwork/transport/disposition step: Connecticut, Illinois, Indiana, Iowa, Louisiana, Michigan, Nebraska, New Jersey, New York. A home vigil is legal in all 50 states per FCA.
- VA green-burial pilot live since Nov. 26, 2024 at three national cemeteries. Other national cemeteries still accept naturally prepared remains in ordinary sections.
- Cremation waiting periods (often 24–48 hours) and who may authorize cremation are state law. Pre-need is state-board / insurance-department law (CA 100% trust; FL 70/30 + CPTF; TX 10% cancel + guaranty fund; NY 100% purchaser-owned within 10 business days).
11Community tactics
- Ask for “Direct Cremation, All-Inclusive” (u/cahutchins, r/Spokane) — Partly. Right shopping label; still unpack whether the crematory fee, refrigeration, and certified copies are inside. FCAPA 2020 shows cash-advance crematory $200–$495 extra at some homes.
- Direct committal and “hold a private service yourself” (u/antiwork34) — Verified. FCA Ten Tips #5–#6; 16 CFR 453.1(g).
- Body donation: “Only thing I had to pay was $250” (u/Buttholes_N_Boobies, 874 upvotes) — Unverified as a national figure. Keep the tactic (ask anatomy programs and research networks). Science Care: $0 if accepted, family pays certified copies. University programs: often $0 plus possible transport.
- Cremation can be arranged by phone with a non-local home (FCA Ten Tips) — Verified. 16 CFR 453.2(b)(1); FCA: “you can use any funeral home, even one far from where you live.”
- Prepaying locks in today’s price (u/matthewthemortician) — Partly. True only on a guaranteed preneed for the listed services. Nonguaranteed and insurance-funded contracts track the future GPL or the policy’s cash value. Irrevocable Medicaid contracts often send leftovers to the state.
