Health-insurance denial and prior-auth appeal writer

Writes a health-insurance denial or prior-authorization appeal, routes it to the right review, and keeps track of each deadline.

Life event: claim or prior-authorization denial for a doctor-ordered test, drug, surgery, or course of treatment

Problem

HealthCare.gov qualified health plans denied 19% of in-network claims and 37% of out-of-network claims in 2024 (KFF, Mar 24, 2026: ~85 million in-network denials of 451 million claims). Consumers appealed fewer than 1%; insurers upheld 66% of internal appeals (~34% overturned). North Carolina’s Smart NC program overturned 153 of 282 external reviews through November 2025 — 53% (NBC News, Dec 10, 2025). Pennsylvania’s Independent External Review overturned 50.1% in its first year (259 reversals; PID, Jan 8, 2025) and about 48% since 2024 (655 of 1,353; PID, Apr 3, 2026).

Intake

  • Denial letter / adverse benefit determination (ABD) / EOB: reason, diagnosis and CPT/HCPCS, guideline citation, appeal address, clocks, urgent-care and external-review rights.
  • Card (front/back), member ID, group number, TPA name; SBC, EOC/certificate; for employer plans, SPD and plan document.
  • Prior-authorization letter; billed codes vs authorized codes.
  • Treating clinician records, failed alternatives, letter of medical necessity.
  • Phone log; plan type (Marketplace / fully insured group / self-funded ERISA / governmental / Medicare Advantage / Medicaid); authorized-representative form if someone else will file.

Playbook

  1. Stabilize care the same day if delay is dangerous. Treating clinician files expedited internal appeal and expedited external review together, attesting that delay would seriously jeopardize life, health, or maximum function, or cause unmanaged severe pain (29 CFR 2560.503-1(m)(1); 45 CFR 147.136(b)(2)(ii)(B) — plan must defer to the attending on urgency). Plan decision: 72 hours (CFR). Healthcare.gov’s “4 business days” is consumer copy; use the regulation.

  2. Identify the plan type in 10 minutes. Marketplace / individual fully insured → state DOI if NAIC-parallel, else HHS FERP. Fully insured group → state process. Self-funded private ERISA → federal IRO; DOL EBSA is the cop. Self-insured city/school → FERP. Medicare Advantage is 42 CFR Part 422 Subpart M (60-day reconsideration, then automatic IRE) — do not mix with ACA clocks. Medicaid MCO: 60-day plan appeal, then fair hearing.

  3. Calendar from receipt, not the letter date. Internal: ≥180 days from receipt (2560.503-1(h)(3)(i)). Plan decides: urgent 72 hours; pre-service 30 days (15 each if two levels); post-service 60 days (30 each). External: ≥ four months after receipt of the final internal ABD (45 CFR 147.136). No corresponding date (Oct 30 → no Feb 30) → first of the fifth month (March 1). Pennsylvania: 15 business days supporting info after IRO assignment; IRO 45 days. Do not burn external on a voluntary second internal level.

  4. Demand the claim file, guideline, and Dx/CPT meanings in writing the same day, free. 2560.503-1(h)(2)(iii), (g). New evidence or a new rationale must be disclosed in advance; the clock tolls if too late to respond (147.136(b)(2)(ii)).

  5. Peer-to-peer is not the appeal. Use it immediately on a PA denial (often 24–72 hours). Confirm in writing. The 180-day written-appeal clock does not toll unless the plan agrees in writing.

  6. One thesis sentence, then exhibits. “This [service] is covered and medically necessary under [plan / NCCN 2A / FDA label] because [one sentence].” Attach LMN, records, the plan’s own guideline, society guidelines, FDA/compendia for off-label cancer. 45 CFR 147.136 Example 1: visit-limit denials that secretly turn on medical necessity are external-review eligible.

  7. File the written internal appeal at the ABD address. Individual market: one internal level. Group: at most two mandatory. Reviewer cannot be the initial denier or their subordinate. Missed 72h / 15d / 30d / 60d clocks → deemed exhaustion (narrow de minimis exception at 147.136(b)(2)(ii)(F)).

  8. File external review the day the internal is upheld. Read the bottom of the final ABD. HHS FERP (AL, FL, GA, TX, WI + most territories; CMS table modified Aug 14, 2026): https://maximusferp.my.site.com/FERP/s/ , 1-888-866-6205, ferp@maximus.com. $0 fee. IRO de novo: 45 days (72 hours expedited), binding. Some state processes may charge ≤$25 (refundable if reversed; $75/year cap) if they authorized a fee as of Nov 18, 2015.

  9. Route CA / NY / TX by the letter. CA Knox-Keene HMO → DMHC IMR. CA fully insured PPO → CDI. NY DFS: patients 4 months; providers on their own behalf 60 days. TX fully insured → TDI IRO form LHL009 sent to the plan/URA (CMS still lists TX in the FERP column — use the denial letter).

  10. Parallel levers. DOI complaint (fully insured). EBSA Benefits Advisor: https://www.askebsa.dol.gov/ or 1-866-444-3272. MHPAEA if MH/SUD limits are tighter than med/surg (2013 rule + CAA 2021 analysis still live). Employer is the ERISA fiduciary. NSA IDR is provider–plan payment, not a member coverage path.

  11. IRO reverse: authorize and pay without delay; stall → DOI/EBSA / ERISA § 502(a). IRO uphold: § 502(a); MA continues to IRE/ALJ (CY 2026 AIC ≥ $200 ALJ / ≥ $1,960 federal court). Dispute collections in writing while the appeal is open.

Checklists

Health-insurance denial and prior-auth appeal writer

  • Plan type identified (Marketplace / fully insured / self-funded ERISA / governmental / MA / Medicaid)
  • ABD saved; 180-day internal and 4-month external clocks from receipt
  • Claim file, guideline, and code meanings requested the same day
  • Expedited requested with attending attestation if delay is dangerous
  • P2P completed and written appeal filed; P2P not treated as the appeal
  • LMN + records + guideline rebuttal + society/FDA exhibits assembled
  • Internal appeal filed with one thesis sentence and numbered exhibits
  • External clock not burned on a voluntary second internal level
  • Final ABD routed to FERP / DMHC / DFS / TDI / plan IRO
  • External review filed; ≤$25 fee only if the letter requires it
  • DOI or DOL EBSA complaint opened for process violations; employer fiduciary asked if self-funded
  • Collections disputed in writing while the appeal is pending

Questions to ask

  • “What is the exact ABD type? Quote the plan provision and the guideline/version/date.”
  • “Was this decided by a licensed clinician in the same or similar specialty who reviewed this member’s records? Name, credentials, date. Was any algorithm used?”
  • “Provide, free, the claim file, the guideline, and Dx/CPT meanings (29 CFR 2560.503-1; 45 CFR 147.136).”
  • “What is the internal appeal address, the 180-day deadline from receipt, and is there a second mandatory level?”
  • “How do I request expedited review and peer-to-peer? Confirm in writing that P2P is not my internal appeal.”
  • “Is this plan fully insured or self-funded? Who is the claims fiduciary and TPA?”
  • “External review: state DOI, HHS FERP, or plan IRO? Fee? Form? Four-month date from receipt?”
  • “What additional documentation would convert this prior-auth denial to an approval? (CMS-0057-F specific reason.)”
  • “MH/SUD: produce the NQTL comparative analysis for this limitation (CAA 2021).”

Red flags

  • Letter omits how to appeal, the 180-day deadline, or external-review rights (deemed exhaustion).
  • “Not appealable” / “information only” on a medical-necessity or experimental denial.
  • Algorithm denial without a named clinician who reviewed this chart. CA SB 1120 (Jan 1, 2025) and TX Ins. Code § 4201.156 (plans on/after Jan 1, 2026) bar AI-only medical-necessity denials for state-regulated UR.
  • Experimental tag on FDA on-label use or NCCN Category 1 / 2A oncology.
  • MH/SUD PA, visit caps, or fail-first stricter than medical/surgical (MHPAEA).
  • Concurrent-care cut with no advance notice sufficient to appeal before termination.
  • Prior auth approved, claim later denied as “not medically necessary” or on a different code.
  • MA clocks used on a commercial plan, or the reverse; NSA IDR pitched as a member coverage path.

Formulas & rules

  • Marketplace 2024 (KFF Mar 24, 2026). 451 million in-network claims, ~85 million denied = 19%. OON 37%. Appeals ≥262,982 of ~85 million = <1%. Internal upheld 165,863/262,982 = 66% (≈34% overturned).
  • Worked clock. ABD received June 1, 2026. Internal = 180 days from receipt = Nov 28, 2026. Final internal received Nov 28 → four-month external = Mar 28, 2027. ABD Oct 30 with no Feb 30 → file by Mar 1.
  • Worked Pennsylvania. IRO assigned May 1. Supporting info due 15 business days ≈ May 22. IRO decision 45 days = June 15. Cumulative 655/1,353 ≈ 48.4%.
  • Worked North Carolina (NBC). 153/282 through Nov 2025 = 54.3%, reported as “about 53%.”
  • Initial plan clocks (2560.503-1(f)(2)). Urgent 72 hours; pre-service 15 days (+15); post-service 30 days (+15). Concurrent cut: notice in time to appeal before termination.
  • CMS-0057-F (Jan 1, 2026). Impacted payers except QHP FFE issuers: PA decision 72 hours expedited / 7 calendar days standard (items/services, not drugs). FHIR API is not a consumer tool until Jan 1, 2027. FERP outage: deadlines July 1–Aug 3, 2026 extended to Oct 2, 2026.

Tools to implement

  1. Appeal-clock calendar. Inputs: letter date, receipt date, claim type, plan type, state, second internal level Y/N. Logic: +180 days from receipt (internal); +four months from final internal (external; no corresponding date → first of fifth month); overlay PA 15-bd/45-day, NY 4-month/60-day provider, CA IMR 6 months. 2. Plan-type router. Inputs: ID card, SPD, state, Marketplace vs employer. Logic: fully insured + NAIC-parallel → state DOI; AL/FL/GA/TX/WI → FERP; self-funded ERISA → plan IRO + DOL; CA HMO → DMHC; NY → DFS; MA → Part 422; Medicaid → fair hearing. 3. Denial-rate context lookup. Inputs: issuer parent, state, year. Logic: KFF 2024 in-network rate; CMS-0057-F 2025 PA metrics (MA 12%/67% overturn; Medicaid MCO 14%/47%; FFM 18%/43%). State variation & 2025–2026 changes

  • CMS-0057-F process rules Jan 1, 2026; FHIR APIs Jan 1, 2027. Self-funded ERISA is not an impacted payer.
  • CMS-4201-F (MA) still the 2026 baseline: NCD/LCD fidelity; AI may assist but cannot solely deny inpatient or terminate post-acute without individual reassessment (CMS FAQ Feb 6, 2024).
  • MHPAEA 2024 rule (89 FR 77586) is not vacated. May 15, 2025 non-enforcement of new-in-2024 provisions until ERIC v. HHS (D.D.C. 25-cv-136) plus 18 months. Statute, 2013 rule, and CAA 2021 comparative-analysis duty remain in force. EBSA FAB 2026-03 (Sep 8, 2026); NPRM to OIRA on or before Dec 18, 2026.
  • CA SB 1120 (Jan 1, 2025): AI shall not deny, delay, or modify on medical necessity. TX SB 815 / Ins. Code § 4201.156 (plans on/after Jan 1, 2026): no automated adverse determination (TDI Bulletin B-0003-26). Gold card HB 3812 (Sep 1, 2025): TDI fully insured only.
  • Illinois Healthcare Protection Act (Jan 1, 2026): no PA for inpatient MH at participating hospitals; no concurrent review first 72 hours. Does not bind ERISA self-funded.
  • PA Act 146 of 2022: first-year 50.1%; cumulative ~48% through Apr 3, 2026. Fully insured / Pennie only. Arizona NAIC-parallel Jan 1, 2025. CA SB 294 died Nov 30, 2024.

Community tactics — verified status

  • Peer-to-peer is not the appeal — Verified. 29 CFR 2560.503-1 / 45 CFR 147.136 require a written claims procedure. Neutral: Healthcare.gov; the CFR.
  • Internal appeal with studies, prior treatments, and a doctor’s letter, then external review — Verified as the correct packet. NC ~53% and PA ~48–50% IRO rates support filing external review, not a guaranteed win.
  • Read the bottom of the denial letter for external review — Verified. 2560.503-1(g) + 147.136. NBC News Dec 10, 2025: Pope family found Smart NC that way.
  • Pennsylvania 15 business days / 45-day IRO / 50.1% — Verified (PID Jan 8, 2025). Update: PID Apr 3, 2026 ~48% (655 of 1,353).
  • ERISA-litigation attorney after repeated denials — Partly. Exhaustion is the § 502(a) prerequisite; federal IRO is still available and binding on self-funded plans.
  • Viral Anthem reversal — Unverified as a tactic. Anecdote; keep out of the playbook.
