Situation Buying a production-builder new home (contract + financing)

01Problem

Production builders condition closing-cost credits and teaser rates on their affiliated lender, and most financed buyers stay captive (Lennar Mortgage 84% of financed buyers in FY2025; DHI Mortgage 81% of Horton closings; Pulte Mortgage 84.7% capture excluding cash; KBHS 85% of financed buyers). Census/HUD CB26-174 (Oct. 27, 2026) put the September 2026 median new-house price at $400,400. A $10,000 credit on a 7.24% note can lose to a $10,000 price cut or a true outside Loan Estimate once APR, Section A, lock length, and the Fannie/FHA contribution cap sit on the same grid.

02Intake

  • Unsigned purchase agreement, lot-premium sheet, spec/option sheet, incentive flyer, and the sentence that ties incentives to the affiliated lender.
  • Appendix D AfBA disclosure plus the captive’s name (Lennar Mortgage, LLC; DHI Mortgage; Pulte Mortgage LLC; KBHS Home Loans; Toll Brothers Mortgage Company).
  • Target product (30-year fixed vs 5/1 ARM; conventional vs FHA/VA/USDA), occupancy, down-payment percent, FICO, intended close vs estimated completion.
  • Official Loan Estimates (all pages) from the captive and two outside lenders, same week, same six items, same lock status.
  • Design-center invoice and builder-paid buydown agreement (temporary 2-1 / 3-2-1 vs permanent points).
  • Rate-lock letter: expiration datetime, extension fee, float-down, and whether a standby/forward (Fannie SFC 887) is in the file.

03Playbook

  1. 01

Get the Appendix D AfBA form before the incentive deadline. 12 CFR 1024.15 / 12 U.S.C. § 2607(c)(4) let a builder own a lender. Safe harbor: Appendix D on a separate paper at or before the referral, ownership, charge or range of charges, and “YOU ARE FREE TO SHOP AROUND.”

  2. 02

Trigger official Loan Estimates, not worksheets. Six items (name, income, SSN, property address, estimate of value, loan amount sought — 12 CFR 1026.2(a)(3)(ii)) start a 3-business-day LE clock (1026.19(e)(1)(iii)(A)). Creditor shall not require a purchase contract as a condition of the LE (1026.19(e)(2)(iii)). Pay only a bona fide credit-report fee before intent to proceed.

  3. 03

Cluster three LEs inside 14 days. Same six items to the captive and two independents the same day. Compare Rate Lock + expiration, note rate, Section A, Section J credits, B vs C, MI/MIP, Cash to Close, APR, TIP, In 5 Years.

  4. 04

Classify the flyer. (a) Closing-cost credit. (b) Temporary 2-1 / 1-0 / 3-2-1 (note rate stays high). (c) Permanent points that cut the note rate. (d) Standby/forward the builder bought before your contract (Fannie SFC 887). A 5/1 ARM teaser is none of those: the payment rate is not the APR.

  5. 05

Run the RESPA “required use” test. 12 CFR 1024.2: optional package, true discount below prices otherwise generally available, not recouped elsewhere. A lot-premium bump, compressed lock, or higher Section A fee that recoups the credit fails the “true discount” half.

  6. 06

Compute the IPC cap. Fannie B3-4.1-02 (05/07/2025): of the lower of price or value — 3% at LTV >90%; 6% at 75.01–90%; 9% at ≤75%; investment 2%. Affiliated-lender buydowns count. FHA 4000.1: 6% of sales price, including buydowns, prepaid interest, MIP, UFMIP; IPCs cannot fund the 3.5% minimum investment. Excess Fannie concessions cut the LTV sale price.

  7. 07

    Convert a 2-1 to cash subsidy. Fannie B2-1.4-04: qualify at the note rate; initial cut ≤3 points; step-up ≤1 point/year; ≤3 years. Subsidy = note-rate P&I minus bought-down P&I, deposited at closing. Servicers must send a 90-day step-up notice (mandatory Nov. 1, 2025).

  8. 08

Convert a permanent buydown to a break-even. One point = 1% of loan amount, connected to a discounted rate (12 CFR 1026.37(f)(1)(i)). A “point” that does not cut that lender’s same-day 0-point note rate is an origination fee. Break-even months = points ÷ monthly P&I savings. A 0.25% cut per point is a market rule of thumb, not a CFPB number (Ask CFPB en-136).

  9. 09

Convert a price cut, then score five-year cost. A $10,000 price cut at 5% down cuts the loan $9,500 and 30 years of interest (and FHA UFMIP). Prefer a price cut when cash-to-close is fine and IPC is tight; prefer a credit when cash is the constraint. Five-year cost = cash to close + 60 × P&I (step-up schedule on a 2-1) + MIP/PMI + remaining principal. After month 24 on a 2-1, the note-rate payment is the payment.

  10. 10

Match lock length to the build. CFPB en-143: locks typically 30, 45, or 60 days. The LE Rate Lock line (1026.37(a)(13)) omits the extension fee. A six-month build needs a written lock through CO, construction-to-perm, or float-down. Get the 90- and 180-day price in writing.

  11. 11

Decode ARM teasers with the APR. Lennar Tulsa promo (fetched Oct. 30, 2026): FHA 5/1 ARM 4.50% (7.672% APR) + up to $10,000 closing costs, sign 10/27/26–11/01/26, close by 11/30/26, “Offers require financing through Lennar Mortgage, LLC.” Sample $205,000, 3.5% down. Eagle Home Mortgage is the former name (rename December 2020); the 10-K and promo use Lennar Mortgage, LLC.

  12. 12

Shop title; decouple the credit; decide. 12 U.S.C. § 2608 (RESPA § 9): seller may not require a particular title company — treble the title charges. Write: “Seller credit of $[X] toward Buyer’s closing costs, independent of lender” (negotiation, not a RESPA right). NAHB HMI Aug. 17, 2026: 35% of builders cut prices (avg 6%); 63% used incentives. Choose the captive when AfBA is in the file, outside LEs lose on five-year cost after IPC, and the lock covers CO. Walk if the house is not for sale without the affiliate — that is required use.

04Checklists

Builder incentive vs. outside Loan Estimate comparator

  • Appendix D AfBA form in hand, separate paper, shop-around legend present
  • Two outside official LEs + captive LE, same week, same product, same lock status
  • Incentive classified: credit / temp buydown / permanent points / standby SFC 887 / ARM teaser
  • Required-use test: optional package, true discount, no recoupment in lot premium or Section A
  • IPC cap computed (Fannie 3/6/9 of lower of price or value; FHA 6% of sales price)
  • 2-1 subsidy deposited at closing; qualify-at-note-rate confirmed
  • Permanent-point break-even vs that lender’s 0-point LE; price-cut alternative scored
  • Five-year cost grid completed (cash to close + 60 payments + remaining principal)
  • Lock covers estimated CO; extension fee in writing
  • ARM APR and year-6 reset compared to a 30-year fixed LE
  • Owner’s title shopped under § 2608; decoupled credit requested; design-center extras in IPC

05Questions to ask

  1. Q01

“Send the Appendix D AfBA disclosure today, including the ownership percentage and the charge or range of charges for [Lennar Mortgage / DHI Mortgage / affiliate].”

  2. Q02

“Itemize, in writing, every credit, rate, lot premium, design-center dollar, and closing date that changes if I use an independent lender.”

  3. Q03

“Is this a temporary 2-1, a permanent point buydown, a standby/forward (Fannie SFC 887), or a 5/1 ARM? What is the note rate used for qualifying?”

  4. Q04

“What is the written lock expiration, extension-fee schedule, and float-down, and will you lock through [estimated CO date] at the same rate and credits?”

  5. Q05

“Confirm IPC math: sales price $[P], LTV [x]%, credit $[C], buydown subsidy $[B]. Which dollars count toward the 3/6/9 or 6% cap?”

  6. Q06

“Will you write the $[credit] into the purchase agreement so it survives if I use an outside lender?”

  7. Q07

“Issue an official Loan Estimate from the six application items only. The only fee I authorize before intent to proceed is a bona fide credit-report fee.”

  8. Q08

“On the ARM: what is the margin, index, caps, and the fully indexed rate used in the APR?”

06Red flags

  • Flyer quotes 4.50% and hides a 7.672% APR on a 5/1 ARM that must close in 30 days

  • “Use our lender or the house is not for sale”

  • Credit recouped in a same-week lot-premium increase

  • Temporary 2-1 sold as a “permanent 2% off”

  • Lock of 30 days on a six-month build, with extension fees unstated

  • Discount “points” that do not cut that lender’s 0-point note rate

  • IPC over the 3% Fannie cap at 5% down, with the excess silently becoming a sales concession

  • Seller-required title company for the owner’s policy

  • LE withheld until the purchase contract is signed

  • Processing or appraisal fee collected before intent to proceed

12 U.S.C. § 2607(c)(4) and 12 CFR 1024.15 require that I am not required to use your affiliated lender, and 12 U.S.C. § 2608 forbids requiring a particular title company as a condition of sale. Send the Appendix D AfBA disclosure today (ownership and charge or range of charges). I will obtain official Loan Estimates from [Lennar Mortgage, LLC / DHI Mortgage / Pulte Mortgage] and two independents on the same product and lock status. Itemize every credit, rate, lot premium, design-center dollar, and deadline that changes if I skip the affiliate (12 CFR 1024.2, “required use”). Write the $[credit] into the purchase agreement as a seller credit toward Buyer’s closing costs, independent of lender.

  • Monthly P&I. (M = P \cdot \frac{r(1+r)^{n}}{(1+r)^{n}-1}) where (r) = annual rate/12 and (n) = 360. PMMS week of Oct. 29, 2026: 30-year 7.24%, 15-year 6.60%. On $380,000: 7.24% P&I $2,589.69; 6.99% $2,525.60; 6.50% $2,401.86.
  • 2-1 buydown, $380,000 note 7.24%. Year 1 at 5.24%: P&I $2,096.02, subsidy $5,924.06. Year 2 at 6.24%: P&I $2,337.25, subsidy $3,029.26. Two-year subsidy at closing: $8,953.32. Qualify at $2,589.69.
  • Permanent 0.25% vs 1 point. $380,000 at 7.24% vs 6.99%: save $64.09/month. One point $3,800. Break-even ≈ 59.3 months. Lifetime interest 7.24% ≈ $552,289; 6.99% ≈ $529,215.
  • $10,000 price cut vs $10,000 credit, 5% down, 7.24%. Price $400,000 → loan $380,000, P&I $2,589.69. Price $390,000 → loan $370,500, P&I $2,524.95 (save $64.74/month; ~$13,807 interest over 30 years). The credit fills cash-to-close and leaves the $380,000 loan.
  • Fannie IPC, $400,000, 5% down (LTV 95%). Cap = $12,000. A $10,000 credit + $8,953 2-1 = $18,953. Excess $6,953 is a sales concession that must cut the LTV sale price, or resize the package.
  • FHA 6% cap, $400,000. Cap = $24,000, including buydowns and UFMIP paid by the builder. 3.5% down = $14,000 cannot come from IPCs.
  • Lennar Tulsa sample, $205,000 FHA, 3.5% down, 4.50% payment rate. Base $197,825; UFMIP $3,461.94; total loan $201,286.94; P&I $1,019.89. Compare the 7.672% APR to a 30-year fixed outside LE. Sign 10/27/26–11/01/26, close by 11/30/26, Lennar Mortgage required.
  • Standby/forward. Fannie B3-4.1-02: a blanket builder-lender rate agreement executed before the sales contract is not an IPC. Deliver with SFC 887 (mandatory for applications on/after Sept. 4, 2024). Bought after you signed → IPC.
  • TRID. LE within 3 business days of the six items. Consummation no earlier than the 7th precise business day after the LE is delivered or mailed. No TILA rescission on purchase-money (15 U.S.C. § 1635; 12 CFR 1026.23(f)(1)).

10State variation

  • Census/HUD CB26-174, Oct. 27, 2026: September 2026 median $400,400, average $472,800, 8.4 months’ supply. Next release Nov. 25, 2026. PMMS Oct. 29, 2026: 30-year 7.24% (prior 7.32%; year-ago 6.17%).
  • Fannie IPC B3-4.1-02 dated 05/07/2025 (SEL-2025-03); note dates on/after Sept. 3, 2025. SFC 887 mandatory for applications on/after Sept. 4, 2024. Temp-buydown 90-day step-up notice mandatory Nov. 1, 2025.
  • NAHB HMI Aug. 17, 2026: 35% of builders cut prices (avg 6%); 63% used incentives. FY2025 captives: Lennar Mortgage 84% of financed buyers (10-K filed Jan. 28, 2026); DHI 81%; Pulte 84.7% ex-cash; KBHS 85%; Toll TBMC 43.4%.
  • TRID unamended as of Oct. 30, 2026. EO 14393 / RFI CFPB-2026-0018 is a request, not a rule. 2026 conforming limit $832,750. No TILA rescission on purchase-money. ILSA 7-day lot revocation does not apply to a house obligated to complete within two years (15 U.S.C. § 1702(a)(2)).

11Community tactics

  • “Don't judge it by the $6k credit. Judge it by the whole loan estimate.” Verified — CFPB multiple-LEs page; 12 CFR 1026.19.
  • Negotiate the credit so it does not depend on the preferred lender. Partly — RESPA forbids required use of the affiliate as a condition of sale; Appendix D says shop around. Optional credits that vanish without the affiliate are the industry model if they are a true discount (12 CFR 1024.2). Decoupling is a contract negotiation.
  • Get an outside quote as leverage; Opendoor’s “paid out of the lender’s rate/fee stack.” Partly — an outside LE is the correct tool (CFPB). The stack mechanism is a vendor explanation; test it on Section A and the note rate.
  • Ask whether a buydown is temporary or permanent (@RealtorTown, 30d). Verified — Fannie B2-1.4-04 vs permanent points; it changes qualifying, IPC, and the payment after year 2.

  1. Incentive vs outside LE comparator. Inputs: sales price, down payment, product, captive and outside note rate/APR, Section A, credits, 2-1 schedule, lock days, estimated CO. Logic: amortizing P&I; convert 2-1 to closing subsidy; apply Fannie 3/6/9 or FHA 6%; 60-month total + remaining principal; flag lock before CO. Outputs: cash to close, year-1/3/5 P&I, five-year cost, IPC headroom, winner. Sources: PMMS, FRED MORTGAGE30US, Fannie B3-4.1-02, Fannie B2-1.4-04, CFPB multiple LEs.
  2. IPC cap checker. Inputs: price, value, occupancy, LTV, credit, buydown subsidy, builder-paid extras. Logic: cap = 3%/6%/9% of min(price, value), or 0.06 × price for FHA. Output: cap, used, excess, price-cut conversion. Source: Fannie B3-4.1-02; HUD FHA IPC.
  3. Live promo decoder (Lennar Tulsa pattern). Inputs: flyer URL, sign window, close-by, payment rate, APR, product, sample price. Logic: parse the captive-lender sentence; compute P&I and UFMIP; compare APR to PMMS 7.24%. Output: days left to sign, close-by risk, ARM vs fixed warning.
